Real Estate Exclusive Right to Sell Agreement Addendum A

Re: This addendum constitutes the entire addendum to complete paragraph # 2 of the exclusive right to sell agreement for 6419 Kiousville Georgesville Road London, Ohio 43140 at Public Reserve Real Estate Auction Sunday May 31st, 2020 at 1:30pm doors open at 11am

Additional Terms and Conditions:

This Reserve (reserve price $169,900) Real Estate online and live auction, & buyer’s premium of 9% for buyers not represented by a real estate agent and 12% for buyers represented by a real estate agent, sells AS-IS without contingencies whatsoever.
High bid plus buyer’s premium will constitute the TOTAL PURCHASE PRICE. The winning bidder will then make a non-refundable Down Payment of 10% of TOTAL PURCHASE PRICE to World Class Title Company via wired funds. Wired funds for the down payment to World Class Title Company the next business day. Wiring instructions will be given directly from World Class Title Company via email. Total Down Payment will be given back to buyer when said buyer closes within terms. If buyer defaults and does not complete the transaction, DOWN PAYMENT will be split 50/50 with Key Realty brokerage and seller within terms of listing agreement. If default occurs, auctioneer will contact backup bidder to offer “position of primary contract” within terms. Every prospective bidder must sign a letter of “irrevocable instruction” which defines that all DOWN PAYMENT funds are non-refundable. Each registered bidder must have a State issued photo Identification and register by signing the “Auction Registration Form” and “Terms & Conditions Form”. Auctioneer may make changes to terms and condition within his fiduciary responsibility to the seller (client), in the best interest of client. If changes are made, they must be reduced to writing and signed by both parties, (buyer and seller). If high bid is $180,000 the buyer’s premium is $16,200 (without an agent representing the buyer) and $21,600 (with an agent) and the total purchase price is $196,200 without and 201,600 with an agent. Therefore, the non-refundable down payment is $19,620. The winning bidder may ask for an extension and if agreed by the seller, buyer agrees to and will pay a $200 per diem split 50/50 with the broker and seller prior to the extension time period. All closing costs are buyer’s responsibility. No Tax credits or proration given to buyer.
Once a bidder has met requirements to bid and becomes the winning bidder (he/she) will sign all necessary contracts digitally and expect an email for down payment funds from World Class Title Company sent same day. Prepare for this transaction by contacting your bank and understanding the necessary steps to successfully wire funds same day. This is the full responsibility of the buyer to have total Down Payment sent next business day, time is of the essence. Winning bidder(s) will then have 30 days from date of live/online auction event to close transaction with World Class Title Company. This exclusive listing agreement, terms and conditions shall be binding upon all parties, their heirs, administrators, executors, successors of interest and assigns. It is Winning bidder(s) obligation to request and conduct if desired a final walk through to determine if there are any conditional changes to the property different than the day of auction. If conditions have changed it is the buyer’s responsibility to notify the auctioneer prior to the closing transaction to verify and disclose. If there are no such notifications and transaction closes, the buyer(s) by default agree to the conditions as per the terms.
